29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) Jobsite, 1254 PA-519, Eighty Four, PA: On or about January 12, 2026, prior to construction activities, the employer did not ensure an employee was provided appropriate trench and excavation safety training in that the employee did not know that previously removed materials needed to be moved at least 2 feet away from the edge of the excavation, exposing the employee to hazards related to excavation wall and spoil pile collapses.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations as protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) Jobsite, 1254 PA-519, Eighty Four, PA: On or about January 12, 2026 during construction activities, the employer did not ensure employees were protected while working in an excavation in that spoil piles were placed immediately on the edges of both sides of the excavation, exposing employees to hazards related to excavation wall and spoil pile collapses.
