Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii). Employee(s) working inside a lifting cage that was attached to a forklift were unclogging trim piping, changing out lighting elements, repairing air conditioning system, among other activities in the production/warehouse located at 312 E. Forest Avenue, Girard, Kansas, were being exposed to fall hazards of approximately 15 - 20 feet due to no fall protection system being used.

29 CFR 1910.30(a)(1): The employer did not provide training for each employee who used personal fall protection systems or who was required to be trained as specified elsewhere in this subpart before the employees were exposed to a fall hazard: Employee(s) working inside a lifting cage that was attached to a forklift located at 312 E. Forest Avenue, Girard, Kansas were exposed to fall hazards due to no training on fall protection systems. The lifting cage was used to access clogged vacuum piping or faulty electrical equipment near the ceiling approximately 15 - 20 feet from the floor.

29 CFR 1910.147(f)(1): When lockout or tagout devices temporarily were removed from the energy isolating device and the machine or equipment was energized to test or position the machine, equipment or component thereof, the sequence of actions were not followed in accordance with 29 CFR 1910.147(f)(1)(i)(v): The employer failed to develop and implement a written setup procedure for the Harris #064 Collator. An employee was setting up the Harris #064 Collator in the production department without specific setup procedures thus exposing an employee to an amputation injury.

Forest, Girard, Kansas using the following powered industrial trucks where the control levers for operating the mast was not legibly marked:. (a) The indentations (Toyota clamp truck) embedded in the first two rubber knobs of the control levers were not highlighted. The last two control levers did not have any labeling. (b) The Hyster P4 forklift, the last two control levers did not have any labeling. (c) The TCM forklift, the control levers did not have any labeling.
