29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 01/29/2026 at a construction site located at 2804 Union Road, Cheektowaga, New York;  employees were working on an existing commercial building from a platform on the forks of a rough terrain forklift. The employees on the platform did not have a harness with a lanyard attached to the boom or basket while operating the lift.  NO ABATEMENT CERTIFICATION REQUIRED

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a) On or about 01/29/2026 at a construction site located at 2804 Union Road, Cheektowaga, New York; employees were removing framing and trusses on a building using a job built work platform attached to the forks of a rough terrain forklift. The use of a personnel platform was not approved for use by the forklift manufacturer, exposing employees to a fall hazards.  NO ABATEMENT CERTIFICATION REQUIRED  Four Seasons Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1582921, citation number 1, item number 1 and was affirmed as a final order on 06/16/2022, with respect to a workplace located at  2921 Transit Road, Elma, New York.
