Employees dispensing toluene or methyl isobutyl ketone from 55-gallon steel drums into steel and/or plastic secondary containers by gravity were exposed to hazards associated with the release of class II flammable liquids in the event the valve was left open.

29 CFR  1910.106(e)(6)(ii): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), were dispensed into containers without the nozzle and container being electrically interconnected:  Thermoseal Inc. doing business as Klinger Thermoseal located at 2350 Campbell Road in Sidney, Ohio;  On or about February 4, 2026, the employer to not ensure containers used to transfer class II flammable liquids were electrically interconnected. Employees dispensing toluene or methyl isobutyl ketone from 55-gallon steel drums into steel and/plastic secondary containers were not bonded and/or grounded. Grounding the steel drums prevents static sparks from being generated which can ignite the liquid when it is transferring, exposing employees to a fire hazard.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  Thermoseal Inc. doing business as Klinger Thermoseal located at 2350 Campbell Road in Sidney, Ohio;  Instance A  On or about February 4, 2026, the employer did not ensure the Graco Drum Pump (Part No.:222-546 Series B948) was guarded. Due to this condition employees tasked with transferring rubber material into mixers via the Graco Drum Pump were exposed to crushing hazards created as the plunger of the drum pump enters the fifty gallon drum containing rubber.    Instance B  On or about February 4, 2026, the employer did not ensure the Graco Drum Pump (Part No.:222-546 Series B948) was guarded. Due to this condition employees tasked with transferring rubber material into mixers via the Graco Drum Pump were exposed to crushing hazards between the base of the Graco Drum Pump and the 55 gallon drum in the raised position.

29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Thermoseal Inc. doing business as Klinger Thermoseal located at 2350 Campbell Road in Sidney, Ohio;  On or about February 4, 2026, the employer the employer did not establish and implement a written respiratory protection program with worksite specific procedures outlining: (1) The selection of respirators for use, (2) Medical evaluations of employees, (3) Fit testing procedures, (4) Cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators, (5) Training of employees in the respiratory hazards to which they are potentially exposed, (6) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance, and (7) Procedures for regularly evaluating the effectiveness of the program. Employees were required to don 3M tight-fitting half mask elastomeric respirators with organic vapor cartridges when mixing chemicals, in the RCM mixing room.
