OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards while working around damaged racking systems.  a) Facility: On or about February 5, 2026, and times prior to, the employer exposed employees to struck-by and crushing hazards, in that damaged racking systems in aisles 9, 10, and 21 were used to store palletized materials and loaded and unloaded by powered industrial trucks.
