OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was operating a rough terrain forklift without maintaining the use of a seat belt which exposed the employee to crushing and struck-by hazards:   (a) Residential Home, 471 B&O Overpass Road, Hedgesville, WV:  On February 3, 2026 and times prior, an employee had been operating a JCB 507-42 Telehandler daily since December 2025 and was not required to utilize the equipped seat belt to ensure they stayed secure within the cab, exposing the employee to crushing and struck by hazards.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (Construction Reference 1926.602(d))  (a) Exterior, Residential Home, 471 B&O Overpass Road, Hedgesville, WV: On February 3, 2026 and times prior an employee was operating a JCB 507-42 Telehandler without having received training and evaluation from the employer. (a) Exterior, Residential Home, 471 B&O Overpass Road, Hedgesville, WV: On February 3, 2026 employees were performing demo clean up operations on a construction site that was not in close proximity to an infirmary, clinic or hospital nor was there a person adequately trained to render first aid.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

(a) Exterior, Residential Home, 471 B&O Overpass Road, Hedgesville, WV: On or about February 3, 2026, the employer failed to report a work-related fatality occurring on February 3, 2026 to OSHA within 8 hours after learning about the work-related fatality.
