29 CFR  1926.252(a):An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s):  a.  On or about February 10, 2026, at the above addressed jobsite, employees performing commercial HVAC upgrade operations were discarding material from the rooftop, dropping material approximately twenty-three (23) feet one (1) inch to the ground with no chute in place, thereby exposing employee(s) to struck-by hazards.

29 CFR  1926.501(b)(10): Each employee engaged in roofing HVAC activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  a. On or about February 10, 2026, at the above addressed jobsite, employees performing commercial HVAC upgrade operations at twenty-three (23) feet one (1) inch above the ground were not protected from falls, thereby exposing employees to fall hazards.

On or about February 10, 2026, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification of record.
