29 CFR  1910.178(p)(1):Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  a)  Warehouse:  On or about February 11, 2026, and at times prior, the employer exposed employees to struck-by hazards in that the employer did not remove from service the "Raymond" model 425-C50QM forklift (serial number 425-14-43764) which had damaged tires and was used by employees for unloading, stocking, retrieving, loading and inventory.

29 CFR 1910.49(d)(2)(ii): The employer did not ensure that personal fall arrest systems are rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level. A free fall may be more than 6 feet (1.8 m) provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more than 6 feet and tested the system to ensure a maximum arresting force of 1,800 pounds (8 kN) is not exceeded.  a)  Warehouse:  On or about February 11, 2026, and at times prior, the employer exposed employees to fall hazards, in that the employer did not ensure that the "Honeywell Miller" model Miller H100 harness and "3M" shock absorbing lanyard model 1341001 (serial number 482032) were rigged to prevent contact with a lower level where the lanyard required a minimum fall clearance of 12.93 feet and the equipment was used at heights between 4 feet and 12.93 feet above a concrete floor when using a "Raymond" model 540-OPC30TT order picker (serial number 540-16-C31027) to retrieve items from steel storage racks.

29 CFR  1910.30(a)(3)(iv): The employer did not train each employee in the correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer.  a)  Warehouse:  On or about February 11, 2026, and at times prior, the employer exposed employees to fall hazards, in that the employer did not provide effective training for inspection, rigging and use of the "Honeywell Miller" model Miller H100 harness with "3M" model 1341001 shock absorbing lanyard (serial number 482032) while employees use this equipment in conjunction with a "Raymond" model 540-OPC30TT order picker (serial number 540-16-C31027) to retrieve items from steel storage racks at heights between 4 feet and 12.93 feet above a concrete floor.  EXACTDISTRIBUTION LLC was previously cited for a violation of 29 CFR  1910.30(a)(1), which was contained in OSHA inspection number 1803022, citation number 1, item number 2-b and was affirmed as a final order on May 30, 2025, with respect to a workplace located at 3075 Chastain Meadows Pkwy, Marietta, GA 30066.

Warehouse:  On or about February 11, 2026, and at times prior, the employer exposed employees to fall hazards, in that the employer did not ensure that employees effectively inspect their fall protection for damage and remove defective components from service.  EXACT DISTRIBUTION LLC was previously cited for a violation of this occupational safety and health standard 29 CFR  1910.140(c)(18), which was contained in OSHA inspection number 1803022, citation number 1, item number 1 and was affirmed as a final order on May 30, 2025, with respect to a workplace located at 3075 Chastain Meadows Pkwy, Marietta, GA 30066.

29 CFR  1903.2(a)(1): The employer did not post and keep posted a notice or notices, to be furnished by the Occupational Safety and Health Administration, U.S. Department of Labor, informing employees of the protections and obligations provided for in the Act, and that for assistance and information, including copies of the Act and of specific safety and health standards, employees should contact the employer or the nearest office of the Department of Labor. Such notice or notices shall be posted by the employer in each establishment in a conspicuous place or places where notices to employees are customarily posted.
