29 CFR  1910.107(b)(5)(i): The spraying operations except electrostatic spraying operations shall be so designed, installed and maintained that the average air velocity over the open face of the booth (or booth cross section during spraying operations) shall be not less than 100 linear feet per minute. Electrostatic spraying operations may be conducted with an air velocity over the open face of the booth of not less than 60 linear feet per minute, or more, depending on the volume of the finishing material being applied and its flammability and explosion characteristics. Visible gauges or audible alarm or pressure activated devices shall be installed to indicate or insure that the required air velocity is maintained. Filter rolls shall be inspected to insure proper replacement of filter media.  a) On or about March 11, 2026, at the establishment located at 1745 East Matthew Drive, De Pere, Wisconsin; the employer did not ensure that the average air velocity over the open face of the DeVilbiss Touch-Up Spray Booth was at least 100 feet per minute (fpm) while spraying flammable primers, such as but not limited to BLACK CV PRIMER (CV8700) and WHITE PRIMER CV (CV8000), exposing each employee to the hazards associated with formaldehyde. The average air velocity across the open face of the DeVilbiss Touch-Up Spray Booth was approximately 87.6 fpm.

On or about and March 11, 2026, at the establishment located at 1745 East Matthew Drive, De Pere, Wisconsin; in the DeVilbiss Touch-Up Spray Booth, a Primer was exposed to formaldehyde that exceeded the STEL permissible exposure limit (PEL) while spraying primers that contained formaldehyde, such as but not limited to BLACK CV PRIMER (CV8700) and WHITE PRIMER CV (CV8000), exposing an employee to the hazards associated with formaldehyde in the following instances:  a) On this date, a Primer was exposed to a STEL of 3.78 ppm of formaldehyde, approximately 1.89 times the PEL of 2 ppm.  b) On this date, a Primer was exposed to a STEL of 2.53 ppm of formaldehyde, approximately 1.27 times the PEL of 2 ppm.  c) On this date, a Primer was exposed to a STEL of 2.46 ppm of formaldehyde, approximately 1.23 times the PEL of 2 ppm.
