29 CFR  1926.453(a)(2): Field modification of the aerial lift was not certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable design and construction requirements of ANSI A92.2-1969.   (a)   On or about 02/19/2026, at the construction renovation site located at 1069 Joseph Ave. in Rochester, New York; a boom lift utilized to glaze windows at a height of 15 feet had been used without inspecting the latch assembly to identify the missing gate or safety latch. The gate latch was broken and an  attempt had been made to use a metal shim to hold gate closed.  NO ABATEMENT CERTIFICATION REQUIRED
