29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: F/V Blue North - Maintenance Shop- On or about February 23, 2026 and at times prior thereto, employees performing emergency maintenance on the ammonia system were exposed to respiratory hazards in that the employer had not determined, through a medical evaluation, the employees' ability to use a respirator before the employee(s) are fit tested or required to use a respirator. Employees were required to use full-face respirators. OSHA Instruction: Shipyard Employment "Tool Bag" Directive - CPL 02-00-162 allows for the applicability of 29 CFR 1910.134(e)(1) in the ship building and ship repair industry.

29 CFR 1910.134(k): The employer did not provide comprehensive, understandable training which did not occur annually and/or more often if necessary: F/V Blue North - Maintenance Shop- On or about February 23, 2026 and at times prior thereto, employees performing maintenance on the ammonia system were exposed to respiratory hazards in that the employer had not provide annual respiratory protection training. Employees wear respirators while investigating refrigerant leaks and changing compressor oil. OSHA Instruction: Shipyard Employment "Tool Bag" Directive - CPL 02-00-162 allows for the applicability of 29 CFR 1910.134(k) in the ship building and ship repair industry.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section: F/V Blue North - Maintenance Shop- On or about February 23, 2026, employees engaged in maintenance activities, were exposed to health hazards in that the employer did not label a secondary chemical container assumed to contain soluble oil. Bristol Wave Seafoods, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(f)(6), which was contained in OSHA inspection number 1808379, citation number 1, item number 1 and was affirmed as a final order on May 5, 2025, with respect to a workplace located at F/V Frontier Mariner.
