29 CFR  1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1):  a) On or about February 2, 2026, at building 900: employees and subcontractors were exposed to asbestos hazards during the removal of Vinyl Composition Tile Black Mastic containing 5% chrysotile asbestos, in that, a survey was not conducted to determine the presence, location and quantity of ACM or PACM.

29 CFR  1926.1101(k)(2)(ii): The building and/or facility owner(s) did not notify prospective employers, tenants, employees of the owner, and all employers of employees who would  be performing work within adjacent areas of the presence, location, and quantity of asbestos containing material or presumed asbestos containing material, at the work sites in their buildings and facilities in writing, or a personal communication between the owner and the person to whom notification must be given or their authorized representatives:   a) On or about February 2, 2026, at building 900: employees and subcontractors were exposed to asbestos hazards during the removal of Vinyl Composition Tile Black Mastic containing 5% chrysotile asbestos, in that, individuals were not notified of the presence, location and quantity of ACM or PACM.
