On or about February 25, 2026, the employer did not ensure temporary employees operating stand-up forklifts in the warehouse received a combination of formal instruction, practical training, and an evaluation of the operator's performance prior to operating a forklift.

29 CFR 1910.178(l)(4)(iii): Refresher training and evaluation. Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. a.) On or about March 3, 2026, the employer did not ensure an evaluation of each powered industrial truck operator's performance was conducted at least once every three years for employees operating stand-up forklifts in the warehouse. As a result, employees continued operating powered industrial vehicles without the required periodic evaluation to verify operators retained the knowledge and skills necessary for safe operation.
