29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, were not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: (a) 14707.5 Quebec St., Thornton, CO, 80602 (Thornton Water Project Segment A): On or before March 3, 2026, the employer failed to ensure that each employee working in an excavation which was approximately 15 feet in depth, 27 feet in width, and 200 feet in length was protected from cave-in hazards. The employer failed to comply with the provisions of 29 CFR 1926.652(b)(2), utilizing Appendix B to Subpart P of Part 1926-Sloping and Benching in that the side walls of the excavation were sloped at approximately 48 degrees. The employer had not complied with the provisions of 1926 Subpart P Appendix B in that the maximum allowable slope associated with Type B soil is an angle of 45 degrees from toe to top.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. 14707 Quebec St., Thornton, CO, 80602 (Thornton Water Project Segment A): On or before March 3, 2026, the employer failed to ensure that each employee was protected from cave-in and engulfment hazards while working inside an inadequately sloped and benched excavation that was approximately 15 feet in depth, 27 feet in width, 200 feet in length, and was comprised of Type B soil.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: 14707 Quebec St., Thornton, CO, 80602 (Thornton Water Project Segment A): On or before March 3, 2026, the employer failed to provide a safe means of egress from an excavation that measured approximately 15 feet in depth, 27 feet in width, and 200 feet in length. Employees installing 42" steel piping worked inside an excavation without a secured, properly placed ladder. This condition increased the risk of entrapment and delayed escape during an emergency, exposing employees to cave-in hazards.
