29 CFR  1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.     a.) On or about March 9, 2026, the employer failed to ensure frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons in that the employer failed to recognize and correct a welding ground lead that laid within standing water while the welder was actively welding exposing employees to electrocution hazards.

29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) shall be installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform).   a.) On or about March 9, 2026, the employer failed to ensure the space between adjacent units and the space between the platform and the uprights was no more than 1 inch (2.5 cm) wide, in that a gap of approximately 19' was present as employees installed brackets from the 4th tier of the scaffolding on the billboards post. As a result, employees working on the scaffold were exposed to a tipping and fall hazard of approximately 15'7".

29 CFR  1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.    a.) On or about March 9, 2026, the employer failed to ensure that the scaffolds and scaffold components were inspected for visible defects by a competent person before each work shift, in that the scaffolding system had  missing handrails located on the 4th tier,  coupling or stacking pins missing from all levels of the scaffolding system, and gaps greater than 1" within the walking/working surface area of the platforms . As a result employees were not only exposed to fall hazards, and scaffolding system had the potential to become dislodged exposing employees to a collapsing and or tipping hazard.

29 CFR  1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  a.) On or about March 9, 2026, the employer failed to ensure a guardrail system was installed along all open sides and ends of the platform in that employees were working from the fourth level of a scaffolding frame system on the east side of a gas station construction site without a complete guardrail system along all open edges of the platform, exposing employees to a fall hazard of approximately 15'7"

29 CFR  1926.452(c)(3): Frames and panels shall be joined together vertically by coupling or stacking pins or equivalent means.   a.) On or about March 9, 2026, the employer failed to ensure the frames and panels of a scaffolding system were joined together vertically by coupling or stacking pins or equivalent means as employees worked from the fourth level of the scaffolding system installing a mounting bracket. As a result the scaffolding frames that were missing pins from every level of the scaffolding system had the potential to become dislodged exposing employees to a collapsing hazard.
