29 CFR 1904.29(b)(4): A form with equivalent information to OSHAs 301, Injury and Illness Incident Report, was not used by the employer to document each recordable injury and illness entered on the OSHA 300 Log.  Location: McLean Southeast, 23 Isaac Street, Middleborough  On or about March 13, 2026, the Excel spreadsheet titled "OSHA 301 Log" used by the employer as the in-house replacement of the OSHA 301, Injury and Illness Incident Report, was not equivalent to the OSHA 301. A separate OSHA 301 Injury and Incident Report report, or an equivalent form, must be completed for each recordable injury or illness entered on the OSHA 300 Log, and each form must be filled out in its entirety.

Location: McLean Southeast, 23 Isaac St., Middleborough  On or about March 13, 2026, the employer did not keep separate OSHA 300 logs for each establishment that has been in operation for one year or longer. McLean Southeast was established in 1999 and moved to its 23 Isaac Street, Middleborough location in 2014, but the employer did not keep separate OSHA 300 logs for this establishment.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  Location: McLean Southeast, 23 Isaac Street, Middleborough  On or about March 18, 2026 an employee was hospitalized due to an incident of workplace violence, where the employee suffered a hip injury and two broken ribs. The employer failed to report the hospitalization until March 23, 2026.

29 CFR  1904.41(a)(2): 29 CFR 1904.41(a)(2) Annual electronic submission of information from OSHA Form 300 Log of Work-Related Injuries and Illnesses and OSHA Form 301 Injury and Illness Incident Report by establishments with 100 or more employees in designated industries. If your establishment had 100 or more employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix B to subpart E of this part, then you must electronically submit information from OSHA Forms 300 and 301 to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the forms.  Location: McLean Southeast, 23 Isaac Street, Middleborough:   On or about March 13, 2026, the employer failed during year 2025 and years prior, to electronically submit information from their OSHA form 300 and 301 or equivalent by 03/02/2026.  a). The establishment employed 150 employees during calendar year 2025.
