OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a struck-by hazard from motor vehicles while providing temporary traffic control and working within the work zone:   a. Site- An employee directing traffic was not protected from struck by hazards where the temporary traffic control procedure in place did not conform to Part VI of the Manual on Uniform Traffic Control Devices 2009 Edition.  The employee directing traffic was flagging from within the traveled way of moving vehicles and was not using a stop/slow paddle, flag, or automated flagger assistance device.  b. Site- An employee working near the centerline of the traveled way of moving vehicles was not protected from struck by hazards where the temporary traffic control procedure in place did not conform to Part VI of the Manual on Uniform Traffic Control Devices 2009 Edition.  The employee flagging from the south end of the work zone entered the work zone to perform construction work prior to having a flagger take their flagging position. The employee was performing work inside the work zone with temporary traffic control at only one end of the work zone, which required temporary traffic control at both ends due to the configuration of the roadway.
