29 CFR 1926.503(c):  "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  On or about February 24, 2026, at a worksite located at Building 5 located at 9980 Highway 70, Minocqua, Wisconsin, employees were exposed to fall hazards of nine feet while removing snow and making preparations for installing walls on a residential construction site without the use of conventional fall protection.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with § 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.
