Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a) On March 25, 2026, the employer failed to ensure that employees used an adequate fall protection system while performing trim work on a newly constructed residential structure, in that the safety net did not extend the length of the scaffold.  As a result, two employees were exposed to a fall hazard of approximately 16'.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and (5) Any other pertinent requirements of this subpart.    a) On March 25, 2026, the employer failed to ensure that employees performing trim work on a pump jack scaffold were trained by a qualified person to recognize and minimize hazards. Specifically, employees were not trained on the requirement for fall protection when working on a scaffold at heights, particularly the requirement for fall protection systems to extend the length of the scaffold.  Two employees were exposed to a fall hazard of approximately 16'.

29 CFR 1926.1053(b) Use: (1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a) On March 25, 2026, the employer failed to protect employees from falls while performing trim work on a residential structure, in that the ladder used for access and egress did not have side rails that extended at least 3 feet above the upper landing surface. As a result, employees were exposed to a fall hazard of approximately 25 feet to the ground below.
