OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing and struck-by hazards from falling vehicles and/or automotive lift parts:  a. Site- On or about April 7, 2026, and at times prior; employees operating the Rotary two post lift in bay 1 were not protected from crushing and struck-by hazards where the automotive lift had damaged and defective restraints on the swing arms to prevent unintentional horizontal movement, the hydraulic reservoir was leaking, required warning decals were removed, and the lift had not received an annual inspection from a qualified inspector.  b. Site- On or about April 7, 2026, and at times prior; employees operating the Rotary two post lift in bay 2 were not protected from crushing and struck-by hazards where the overhead stop bar limit switch was not functioning and the lift had not received an annual inspection from a qualified inspector. The bay 2 automotive lift had previously sustained structural damage when an employee had elevated a vehicle up into the cross member connecting the two posts at the top where the overhead stop bar limit switch was not functioning and did not prevent the contact.  c. Site- On or about April 7, 2026, and at times prior; employees operating the Ben Pearson 9000SA two post lift in bay 3 were not protected from crushing and struck-by hazards where the automotive lift had damaged and defective restraints on the swing arms to prevent unintentional horizontal movement, the adjustable length swing arms did not have bolts to prevent the swing arms sections from separating, the overhead stop bar limit switch was not functioning, the cables used to operate the automated locking devices on the lift were damaged and not usable, and the lift had not received an annual inspection from a qualified inspector.  d. Site- On or about April 7, 2026, and at times prior; employees operating the Ben Pearson 12000SI two post lift in bay 4 were not protected from crushing and struck-by hazards where the automotive lift had damaged and defective restraints on the swing arms to prevent unintentional horizontal movement, the adjustable length swing arms did not have bolts to prevent the swing arms sections from separating, the overhead stop bar limit switch was not functioning, lift pads on the swing arms were substantially worn and damaged, the pneumatic lines used to operate the automated locking devices on the lift were damaged and not usable, and the lift had not received an annual inspection from a qualified inspector.  e. Site- On or about April 7, 2026, and at times prior; employees operating the Rotary SP88 two post lift in bay 5 were not protected from crushing and struck-by hazards where the automotive lift had damaged and defective restraints on the swing arms to prevent unintentional horizontal movement, required warning decals were removed, and the lift had not received an annual inspection from a qualified inspector.  f. Site- On or about April 7, 2026, and at times prior; employees operating the four post alignment lift in bay 6 were not protected from crushing and struck-by hazards where the automotive lift had not received an annual inspection from a qualified inspector.
