29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a) 51, 53, 55, 57, 59 Primrose Court, Manalapan, NJ 07726: Employer did not ensure that employees exposed to head injuries while doing framing and other related work were protected employee was using a pneumatic nail gun while employees were working under him while he was installing framing. Conditions observed on or about 04/15/2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) 51, 53, 55, 57, 59 Primrose Court, Manalapan, NJ 07726: CSHO observed two employees exposed to falling debris and another using a pneumatic nail gun while they were working on the 2nd & 3rd levels of the townhouses being built and not wearing PPE such as safety glasses to protect them from flying debris. Conditions observed on or about 04/15/2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a) 51, 53, 55, 57, 59 Primrose Court, Manalapan, NJ 07726: Employees engaged in framing installation and other related activities were exposed to fall hazards, roughly 20 & 30 feet to the ground surface below, when walking on and working near unprotected edges of the 2nd & 3rd level of residential townhouses being constructed without the use of fall protection. Condition observed on or about 04/15/2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  (a) 51, 53, 55, 57, 59 Primrose Court, Manalapan, NJ 07726: Employees were not utilizing fall protection and were exposed to fall hazards up to 20 & 30 feet to ground surface below when performing framing installation and other related activities while not utilizing fall protection at the worksite. The workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii). Condition observed on or about 04/15/2026.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
