29 CFR  1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a. On or about April 21, 2026, located at 13050 Miller Road, Johnstown, Ohio 43031, the employer did not ensure that an employee was protected from cave-in hazards when they performed commercial conduit tubing installation work in an open trench that was approximately 13 feet deep at the gas line location of the open trench excavation. No protective shielding was installed at the gas line location when an employee conducted work under the gas line location. The condition exposed the employee to cave-in hazards as a result.
