1926.21(b)(2)  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   On or about May 21, 2026 Location: 103 S Broadway, TARRYTOWN, NY 10591  A) Employees were not trained to recognize and avoid hazards and unsafe conditions including the use of eye protection, improper use of ladders and impalement hazards from protruding uncapped reenforcing steel.   NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.  ABATEMENT DUE DATE: JULY 10, 2026

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed   On or about May 21, 2026 Location: 103 S Broadway, TARRYTOWN, NY 10591  a) Employees were exposed to approximately 6 ft fall while accessing working surface with an extension ladder that did not extend 3 ft above the top landing.
