29 CFR  1926.102(a)(1): The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   On or about April 21, 2026, at a residential job site, located at 1775 Lynn Rd., Kent OH 44240, the employer failed to ensure that employees who were operating a pneumatic nail gun while performing roofing activities, were wearing protective eyewear. Employees were exposed to flying debris and nails from the nail guns.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about April 21, 2026, at a residential job site, located at 1775 Lynn Rd., Kent OH 44240, the employer failed to ensure employees, who were working on a residential roof of approximately 30 feet at varying levels, were protected from a fall from height hazards in that employees were not wearing a personal fall protection harness nor were there any other fall protections/restraints in place.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about April 21, 2026, at a residential job site, located at 1775 Lynn Rd., Kent OH 44240, the employer failed to ensure that portable ladders being used to access the upper leading edge of the residential roof, which is approximately 20 feet, had the rungs of the ladders at least 3 feet/rungs above this point.   Employees were exposed to a fall from height hazard of up to 20 feet.
