29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   On or about June 3, 2026, at a residential multi plex job site, located at 30 S. Pershing Ave., Akron OH 44313, the employer failed to ensure that hard hats were worn by employees, including the owner, while working on the ground next to the scrap dumpster where roofing materials were being thrown off the top of the roof (20 feet below).  Employees were exposed to struck by hazards from the materials that were being thrown down to the ground dumpster; often times missing the dumpster.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about June 3, 2026, at a residential multi plex job site, located at 30 S. Pershing Ave., Akron OH 44313, the employer failed to ensure employees, who were working on a residential roof of approximately 20-25 feet at varying levels, were protected from a fall hazards in that employees were not wearing a personal fall protection harness nor were there any other fall protections/restraints in place.

Pershing Ave., Akron OH 44313, the employer failed to train employees in the recognition of potential fall hazards and effective means of prevention and protection from such.  Employees were exposed to a fall from height hazard of up to 20-25 feet at varying levels.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about June 3, 2026, at a residential multi plex job site, located at 30 S. Pershing Ave., Akron OH 44313, the employer failed to ensure that portable ladders being used to access the upper leading edge of the residential roof, which is approximately 20 feet, had the rungs of the ladders placed at least 3 feet/rungs above this point. Employees were exposed to a fall from height hazard of up to 20 feet.
