Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of fluid injection into the spray painters body: a) Spray Area, Plant Number Two (2) - The tip guard was removed from the airless spray gun operation at 2,000 p.s.i., on or about August 12, 1987. b) Spray Room, Plant Number One (1) - The tip guard was removed from airless spray gun operating at 2,000 p.s.i., on or about August 12, 1987. Among other methods, one feasible and acceptable abatement method is to install the tip guard.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of finger amputation from the unintentional activation of the shear: a) Fabrication - Stoil shear, number 5126, without a guard over the foot activation bar, on or about August 12, 1987. Among other methods, one feasible and acceptable abatement method is to install a guard over the foot activation bar.
