Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of flying debris: At this location, in the central yard adjacent to the Giant Shear, employees were exposed to the hazards of flying shards in that 90 psi. compressed air was delivered to the area via Poly-Vinyl-Chloride (PVC) piping. Plastic pipe is subject to shattering and couplings are subject to failure when exposed to the pressures of compressed gasses. One acceptable means of abatement would be to replace the existing PVC piping with a type suitable for the transmission of compressed gasses.
