Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees. On October 23, 2002, the employer did not ensure that an employee who was operating a rough terrain forklift at the northwest corner of Terminal D at DFW Airport fastened the seat belt that was equipped with the unit. Hazards created when seat belts are not utilized include, but are not limited to: being caught between the overhead guard and lower surface (ground) in the event of a tipover and/or being ran over in the event the operator is thrown out of the lift.n
