Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to a hazard of falling and/or
being crushed in the
event of a scissor lift turnover.
As part of a fall prevention system, the employer has significantly
modified a scissor lift
platform, without obtaining manufacturers approval, while using the lift
as a tie off point for
fall protection equipment.  Singularly, and in conjunction, the lift
modification and use as a
fall protection tie off point create side loading factors not originally
intended by the
manufacturer for this device.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
(a)  Obtain written approval from the manufacturer of the scissor lift as
outlined in
the American National Standard for Self Propelled Elevating Work
Platforms,  ANSI
A92.6-1999.  This approval must include the intended use of the lift and
whether or
not the lift is capable of sustaining the type of side loading necessary
(without failure)
in the event the lift is exposed to a fall issue.
(b)  Install the original platform as designed by the manufacturer.  In
the event any of
the manufacturer's original components were modified to accommodate the
company
fabricated platform, the lift should be removed from service.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.
