Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and explosion: a) On or about 2:13 a.m. on Saturday, September 18, 2004, an explosion and fire occurred at Hospira, Inc., located at 1401 Sheridan Road, M3B, North Chicago, Illinois. Employees of Hospira, Inc. were exposed to the hazards of fire and explosion from a release of polysiloxane heat transfer fluid (Syltherm XLT, Dow Chemical) heated above its flash point by a flanged immersion heater. No abatement is required for this item because the equipment (Lyo #9) has been removed from service. However, in the event the above equipment is placed back into service, Hospira, Inc. will abate the hazards. Among other methods, feasible and acceptable means of abatement to correct these hazards include: 1) Conduct routine maintenance for the "oil heater safety thermostat" to ensure that it properly functions as specified in Section 7.5 of the BOC Edwards Calumatic Installation and Maintenance Manual prepared by BOC Edwards Calumatic in March 1995; and 2) Conduct daily inspections of the system to ensure that no polysiloxane heat transfer fluid (Syltherm XLT, Dow Chemical) leaks have occurred and verify that the header tank oil level is in the proper range as specified in Section 7.2.6 of the BOC Edwards Calumatic Installation and Maintenance Manual. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
