Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to

(a)On or about December 22, 2005, at City Dock #30, the employer did not
ensure that operators kept a clear view of their fork lift's path of
travel to
prevent exposing pedestrians to the hazard of being struck by the fork
lift.
(b)On or about December 22, 2005, at City Dock #30, the employer did not
ensure that access to the rear swing area of maneuvering fork trucks was
restricted to prevent employee exposure to the hazard of being crushed
between the fork truck and other objects or vehicles.
One method of abating this hazard is to implement and enforce The American
Society of Mechanical Engineers, ASME B56.1, Safety Standard for Low and
High Lift Trucks, requirement for the operator to keep a clear view of
travel.
