29 CFR 1917.43(c)(5): Powered industrial trucks were not maintained in safe working order.       The employer does not maintain powered industrial trucks in safe working order.           a.   This violation was observed on or about June 17, 2013, at the Port of Houston GPT Terminal, where employees were unloading the vessel SCM FEDRA and were exposed to struck-by hazards when operating a Caterpillar Forklift  with the accelerator pedal duct taped to the accelerator linkage rod.           b.  This violation was observed on or about June 17, 2013, at the Port of Houston GPT Terminal, where employees were unloading the vessel SCM FEDRA and were exposed to struck-by hazards when operating a Caterpillar Forklift with an inoperable horn.           c.  This violation was observed on or about June 17, 2013, at the Port of Houston GPT Terminal, where employees were unloading the vessel SCM FEDRA and were exposed to struck-by hazards when operating a Kalmer Forklift  with an inoperable horn.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to all power industrial trucks used on site have been repaired and maintained in a safe working order.

29 CFR 1918.32(b): The edge of a hatch section, or of stowed cargo, was not guarded by a vertical safety net or other means providing equal fall protection to exposed employees.     The employer does not protect employees working near the edge of a hatch section, or of stowed cargo, which was not guarded by a vertical safety net or other means providing equal fall protection to exposed employees.  This violation was observed on or about June 17, 2013, at the Port of Houston GPT Terminal, where employees were unloading the vessel SCM FEDRA and the gang was exposed to fall hazards of approximately 16 feet to a lower level when unloading cargo near an unprotected edge in hatch 1.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when gangs are working near the edge of a hatch they are protected from falling.

29 CFR 1918.81(a): Loose dunnage or debris hanging or protruding from loads was not removed.     The employer does not protect employees from loose dunnage or debris hanging or protruding from loads. This violation was observed on or about June 17, 2013, at the Port of Houston GPT Terminal, where employees were unloading the vessel SCM FEDRA and were exposed to struck-by hazards when a load of aluminum ingots were lifted overhead without removing the loose wood dunnage laid on top of the load.          Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from struck-by hazards when loads are lifted overhead by removing all loose dunnage from the load.
