Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)Shop 17, on or about 01/10/07: Hoist # 17-10 had a broken safety clip on the hook. b)Shop 17, on or about 01/10/07: Hoist # 17-23 had a broken safety clip on the hook. c)Shipping Department, on or about 01/10/07: Hoist # 7-05 the directional markings on the control did not match actual movements in that the "up" controller moved the hook "down" and the "down" controller moved the hook "up".
