Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fire hazards:
a) Paint/fiberglass Department - Superox 46-702 (contains methyl ethyl
ketone peroxide) was
not stored within the recommended storage temperature range (80 degrees
Fahrenheit or below)
and it was stored within 25 feet of flammable liquids.
One feasible means of abatement, among others is to provide storage areas
which conform to
NFPA 432 - Code for the Storage of Organic Peroxide Formulations. NFPA 432
(2002) states
that "storage areas shall be maintained within the recommended storage
temperature range for
the materials stored." (Chapter 4.4.1) In addition, "incompatible
materials and flammable liquids
shall not be stored within 25 ft of organic peroxide formulations."
(Chapter 4.11.3.1)
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
