Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to fall hazards:
a) Transco Railway Products, Inc. - Toledo, OH: On or about May 5, 2011,
an employee was
exposed to a seven foot fall hazard when working from a platform that was
supported by a
forklift.  The employee, performing maintenance work on a railway boxcar,
was elevated in a
parts basket that was not equipped with a standard guardrail.
Among other methods, one feasible and acceptable means of abetment is to
follow the American
National Standards Institute ANSI/ITSDF B56.1-2005: Safety Standard for
Low Lift and High
Lift Trucks as applicable - 7.37.1(d) Restraining means such as a
guardrail, or means for
securing personnel whenever the platform can be elevated to a height
greater
than 47".  (1) A
guard rail shall have a height above the platform floor of not less than
36" or more than 42"
around its upper periphery and include a midrail.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.

was missing or not
functioning adequately.
Among other methods, one feasible and acceptable means of abatement is to
follow the
American National Standards Institute ANSI/SIA A92.6-1999: Self-Propelled
Elevating Work
Platforms as applicable - 8.8 (2) Guardrails are installed and access
gates or openings are closed
per the manufacturer's instructions.
In accordance with 29 CFR 1903.19(d), abatement certification is required
