Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about July 15, 2011, and at times prior thereto, employees on the west side of the east slip were exposed to a struck-by hazard due to a falling boom and load from a Manitowoc crawler crane Model Number: 4500, Serial Number: 4503. Among other methods, one feasible and acceptable method to correct this hazard would be to inspect, in accordance with the manufacturer's recommendations, the worm shaft and gear for damage and excessive wear each time the oil for the boom hoist is changed or every 2000 hours or six months, whichever comes first. If either part is worn excessively or damaged, replace both parts.
