29 CFR 1910.134(g)(1)(i)(A): The employer permitted respirators with tight-fitting facepieces to be worn by employees who had facial hair that came between the sealing surfaces of the facepiece and the face or that interfered with valve function: a. Memorial Bridge jobsite, Portsmouth, NH - On 2/23/12, employees required to wear tight-fitting facepiece respirators for protection against lead during torch cutting operations were observed with facial hair that could interfere with the seal.

29 CFR 1926.62(d)(2)(iv): Until the employer performed an employee exposure assessment as required by 29 CFR 1926.62(d), and documented that the employee(s) performing any of the tasks listed in 29 CFR 1926.62(d)(iv) were not exposed to lead in excess of 2,500 micrograms per cubic meter, 50 times the Permissible Exposure Limit, the employer did not treat the employee(s) as if the employee(s) were exposed to lead in excess of 2,500 micrograms per meter cubed, and did not implement employee protective measures as prescribed in 29 CFR 1926.62(d)(2)(v): a. Memorial Bridge jobsite, Portsmouth, NH - From the start of torch cutting operations in January 2012, the employer did not provide change areas for workers in accordance with 1926.62(i)(2), until on or about 2/13/12, when the decon trailer with change areas arrived on site.
