Construction Reference: 1926.103 NOTE: The requirements applicable to construction work under this section are identical to those set forth at 1910.134 of this chapter. 29 CFR 1910.134(k)(1)(i): The employer did not ensure that each employee could demonstrate knowledge of why the respirator was necessary and how improper fit, usage, or maintenance could compromise the protective effect of the respirator: a) On or about 19 July 2012, the employer did not ensure that employee(s) wearing tight-fitting respirators demonstrated knowledge as to why improper fit and maintenance of a respirator can compromise the protective effect of the respirator. Three instances were observed among the four site employees. The result was a reduction of the protective effect of the respirator. 1) Three of the site employees had facial hair that obstructed the sealing surface between the elastomeric facepiece and the face. 2) One of the site employees used a respirator with broken straps and damaged inhalation valves. 3) Three of the site employees did not maintain their respirator in a clean and sanitary condition.

The employer did not determine if they were exposed to Lead at or above the action level. The paint removed at the site was determined to contain up to 26.8% Lead. Fortune Painting Company Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.62(d)(1)(i) which was contained in OSHA Inspection # 311942643, Citation Number 1, Item Number 7, issued on 6/10/2008, and was affirmed on 6/25/2008, with respect to a workplace located at 476 Oakwood; Lake Forest, IL 60045.

29 CFR 1926.62(d)(2)(v)(B): Until the employer performs an employee exposure assessment as required under paragraph (d) of this section and determines actual employee exposure, the employer did not provide to employees performing the tasks described in (d)(2)(1), (d)(2)(ii), (d)(2)(iii), and (d)(2)(iv) of this section with interim, appropriate personal protective equipment in accordance with paragraph (g) of this section: a) On or about 19 July 2012, the employer required painters to remove paint containing lead from the exterior of a wood-framed single family house by grinding and using a heat gun. The employer did not provide appropriate personal protective clothing and equipment (including but not limited to disposable shoe coverlets and gloves) until an exposure assessment determined the actual employee exposure to lead. The paint removed at the site was determined to contain up to 26.8% Lead.
