29 CFR 1926.62(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:    a) On November 5, 2015, surfaces were not maintained as free as practicable of accumulation of lead.  Wipe samples taken from various places including; the top of a vacuum where an employee placed his respirator during lunch, the dashboard of the company van, the passenger seat of the company van, and the top of an employee's lunchbox indicated the presence of lead.  Measurements ranged from 9.05-164.1 micrograms of lead.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter.    29 CFR 1910.134(h)(1)(i): Respirators issued for the exclusive use of an employee were not cleaned and disinfected as often as necessary to be maintained in a sanitary condition:  (Construction Reference 1926.103)    a) On November 5, 2015, Fortune Painting Company, Inc. did not ensure that employees using full-face respirators cleaned and maintained the respirators in a sanitary condition.  Wipe samples taken from the inside of the employees' respirators indicated the presence of 82.67 and 22.04 micrograms of lead.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.    Fortune Painting Company, Inc. was previously cited for this OSHA Safety and Health Standard 1910.134(h)(1)(i)  which was contained in OSHA inspection number 531818, Citation number 1, Item number 2 with respect to the workplace located at 716 Clinton Pl., Evanston, IL 60202, and was affirmed as a final order on April 12, 2013.
