29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    Employees working from the top of a water storage tank were exposed to falls of approximately 40 feet to a lower level. The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(1):     "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    Employees working from the top of a water storage tank were exposed to falls of approximately 40 feet to a lower level.  Employees were not protected from falling by guardrail systems, safety net systems, or a personal fall arrest systems or any other approved means.

29 CFR 1926.502(d)(10)(i):     Except as provided in paragraph (d)(10)(ii) of this section, when vertical lifelines are used, each employee shall be attached to a separate lifeline.    Employees using a fixed ladder to access the top of a 40 ft. tall tank were not tied off to the supplied vertical lifeline attached to the fixed ladder.

29 CFR 1926.1053(b)(17):     Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, shall be withdrawn from service until repaired. The requirement to withdraw a defective ladder from service is satisfied if the ladder is either:    Employees were exposed to fall hazards when ascending and descending a 40 ft. fixed ladder. The bottom 5 feet 2 inches of the ladder was removed.      Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
