OSH ACT of 1970 Section (5)(a)(1):  Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to caught between and struck by hazard while operating the freight elevator:    a)  On or about October 17, 2012, employees were operating a freight elevator which was not equipped with an interior car gate, exposing employees to the hazard of amputation.     Among others, feasible and acceptable method of abatement would be to follow ASME A17.1-2010 - Safety code for Elevators and Escalators, Paragraph 2.14.1.1, and equip the elevator with an interior car gate.      b)  On or about October 17, 2012, employees were operating a freight elevator which was not equipped with a top car enclosure, exposing employees to struck-by hazards caused by the materials falling from upper floors.      Among others, feasible and acceptable method of abatement would be to follow ASME A17.1-2010 - Safety code for Elevators and Escalators, Paragraph 2.14.1.6.1, and equip the elevator with a top car enclosure.    c)  On or about October 17, 2012, employees were operating a freight elevator which was not equipped with an emergency stop switch in order to stop the elevator in case of emergency.      Among others, feasible and acceptable method of abatement would be to follow ASME A17.1-2010 - Safety code for Elevators and Escalators, Paragraph 2.26.2.5, and equip the elevator with a red in color, conspicuously and permanently marked emergency stop switch.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
