OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: On or about October 24, 2012, the employer did not ensure that employees performing welding actvities were protected from the hazard of falling when working from the following: a) Employees used a SkyJack SJ6832 scissor lift and were standing on the top and mid guard rails. b) An employee used a locally manufactured man lift with a Gehl RS8-42 telescopic handler and was standing on the mid rails.

29 CFR 1926.453(b)(2)(iv): Employee(s) were not standing firmly on the floor of the basket, were sitting or climbing on the edge of the basket, or were using planks, ladders, or other devices for a work position: On or about October 24, 2012, an employee working from a Genie S-40 aerial lift was performing welding activities while standing on the mid rails of the lift. Employees were exposed to the hazard of falling.
