OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by falling tiltwall: On or about January 10, 2018, and in times prior thereto, iron workers were lifting tiltwall panels using inserts and clutches from different manufacturers, exposing employees to the hazards to being struck by tiltwall panels in the event of failure.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about January 10, 2018, and in times prior thereto, employer did not train employees to make sure the release chains were straightened out down the length of the panel. This created a risk of the release lines and lifting hardware becoming entangled resulting in the release of the clamp unexpectedly. This condition exposed workers to a hazard of being struck by rigging and concrete tilt-wall panel at the construction site.
