OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:    a) Eagle Bridge Co. on or about November 16, 2012, at the site of the Reservoir Rd Bridge on I-75, Lima, OH: The employer failed to ensure a site specific safety plan was developed and implemented for safe employee access and egress to and from the demarcated roadway work zone. During night time road construction operations, an employee operating an aerial lift across an active lane of an interstate highway was struck by a tractor-trailer vehicle.      One feasible and acceptable method to correct this hazard is to develop and implement a site specific safety plan which identifies explicit procedures for moving equipment and/or workers across active highway lanes. This plan should consider and reference factors such as but not limited to: environmental concerns, equipment types and methods of communication. When the job task requires an employee to cross active highway to gain access/egress to and from their work area, the employer should utilize ANSI A10.47  2009  Section 6.4, in that prior to starting highway work the employer should develop and implement a specific plan for safe worker access/egress to and from the work area.
