29 CFR 1910.178(a)(4):     Modifications and additions which affect capacity and safe operation of the powered industrial truck were performed by the employer without the manufacturer's prior written approval:    Exel Logistics, located at 31 Curtis Drive, Shelby, OH 44875: On or about 12/12/2012, the employer failed to obtain manufacturer's approval to use Cascade remanufactured lift truck front end attachment (Catalog # 40D-TC-SP, Serial # SELR-1385-T-5) with a Caterpillar forklift (Model EC25K, Serial # A3EC241242). The forklift with the attachment was used to move products throughout the facility. Employees were exposed to crushing, struck-by, caught in between, and tip over hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(4)(ii)(B):     Refresher training in relevant topics shall be provided to the operator when the operator has been involved in an accident or near-miss incident:    Exel Logistics, located at 31 Curtis Drive, Shelby, OH 44875: On or about 10/23/2012, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in the accident while driving Caterpillar forklift (Model EC25K, Serial # A3EC241242) in the facility, exposing employees to struck-by, caught-in-between, and tip-over hazards.    Exel Logistics was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1910.178(l)(4)(ii)), which was contained in OSHA Inspection # 313935611, Citation number 1,  Item number 1, and was affirmed as a final order on 07/19/2010, with respect to a workplace located at 1260 Sycamore Rd., Manteno, IL 60950.    No additional abatement information is needed for this item.
