29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section. Estad Stamping and Mfg. Co. had employees perform maintenance operations on equipment including but not limited to: nail presses and mechanical power presses, and the employer did not develop, document, and utilize an energy control procedure for each piece of equipment. These energy control procedures would include the following: a. A specific statement of the intended use of the procedure, b. Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy, c. Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them, and d. Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets. Estad Stamping and Mfg. Co. had employees using hazardous chemicals daily at the facility, and the employer did not provide the employees with any hazard communication training. This training would include the following: Information: a. The requirements of this section, b. Any operations in their work area where hazardous chemicals were present, and c. The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and material safety data sheets. Training: a. Methods and observations that may be used to detect the presence or release of a hazardous chemical in their work area, b. The physical and health hazards of the chemicals in their work area, c. The measures employees can take to protect themselves from these hazards, and d. The details of the hazard communication program developed by the employer.
