29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. An employee, operating the gang machine, was exposed to a noise dose of 345.8%, or an equivalent dBA (decibels A scale) of 98.9 dBA, which is capable of causing permanent hearing loss. The sample was conducted for 479 minutes during one shift on February 14, 2013. b. An employee, operating the gang machine, was exposed to a noise dose of 427.3%, or an equivalent dBA of 100.4 dBA, which is capable of causing permanent hearing loss. The sample was conducted for 470 minutes during one shift on February 14, 2013. The employer failed to provide an effective hearing conservation program in that employees were not provided: · Baseline audiograms, · Annual Audiograms, or · Hearing protection training that included information on the advantages and disadvantages of hearing protectors, the attenuation factors of various types of hearing protection, and instructions on the selection, fitting, use and care of the various types hearing protectors.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a. On or about February 13, 2013, the employer provided employees SAS N95 Particulate Respirators and 3M Particulate Respirators for voluntary use while cleaning wood debris in the upper level saw mill area. The employer had neither established nor implemented a written respirator protection program.
