29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about February 26, 2013, employees were exposed to a fall of approximately 6 feet in height to the ground level below, while using a Werner 16 feet extension ladder that extended approximately 2 feet beyond the landing, to access the trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): On or about February 26, 2013, employees were exposed to a trench collapse from inappropriately positioned hydraulic cylinders that were approximately 5 feet from the bottom of the trench, while employees were installing a gas line. The Badeco, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 314305889, citation number 02 item number 001 and was affirmed as a final order on 06/13/2011, with respect to a workplace located at 6000 De Zavala Road, San Antonio, TX 78249.
