29 CFR 1910.1200(e)(1)(i): The employer exposed employees to toxic, hazardous substances and did not compile a complete list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.   a. On or about 03/07/2013, Holcim Inc., located at 2169 Channel Ave, Memphis, TN, did not develop a complete inventory of hazardous materials currently being used on the dock and maintenance shop at the 2169 Channel Ave, Memphis,TN location. The list did not include Rustoleum 7543 Safety Paint, Lubriplate Gear Shield, LPS Chain Mate, and Rustoleum Primer. Without proper information on hazardous materials, employees could mis-handle materials and expose themselves to possible allergic reactions, skin, and respiratory irritations.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical.   On or about 3/7/2013, Holcim Inc., located at 2169 Channel Ave, Memphis, TN, exposed employees to acute and/or chronic chemical exposures that could cause bodily injury and/or disease, allergic reactions, and various irritations both internal and external and did not maintain a copy of the Safety Data Sheet for Rustoleum 7543 Safety Paint, Lubriplate Gear Shield, LPS Chain Mate, and Rustoleum Primer.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
