29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) Jobsite safety inspection was not provided; the employer did not ensure that aerial lifts maintain positions far enough away from each other to avoid having objects fall from one aerial lift onto another aerial lift lower down. Location: 4 WTC, New York, N.Y Employer was using aerial lifts to install window frame caps on the east side of the building. On or about 4/11/2013 NOTE: BECAUSE THE EMPLOYER CORRECTED THIS ITEM DURING THE INSPECTION THE EMPLOYER IS NOT REQUIRED TO SUBMIT ABATEMENT CERTIFICATION NOR DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(c): The employer did not ensure that when employees were exposed to falling objects: In addition to having employees wear hardhats, the employer shall implement one of the measures outlined in 501(c)(1) through (c)(3) which include: Provide a toeboard, or screen or the equivalent, or a canopy, or keep objects back away from the edge, or barricade the area to which objects can fall: a) Employees working in one aerial lift at the 10 ft elevation were exposed to falling objects when two other aerial lifts were being operated 30 feet overhead. An 18 ft long piece of metal window cap fell, hitting the lower aerial lift. Location: 4 WTC, New York, N.Y On the east side of the building. On or about 4/11/2013 NOTE: BECAUSE THE EMPLOYER CORRECTED THIS ITEM DURING THE INSPECTION THE EMPLOYER IS NOT REQUIRED TO SUBMIT ABATEMENT CERTIFICATION NOR DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
